Scope

This policy describes the processing of personal data through MarketNail, an online marketplace for nail and beauty professionals, covering visitors, customers, business representatives, sellers and newsletter subscribers. Sellers may provide their own notices for processing they undertake independently.

Accounts and registration

We process identifiers, contact details, protected credentials, business information, addresses and account activity to create and manage accounts, authenticate users, provide support and keep the platform secure. Legal bases: contract or pre-contractual steps (GDPR Art. 6(1)(b)); legitimate interests in platform security and abuse prevention (Art. 6(1)(f)).

Purchases, orders and sellers

We process billing and delivery information, order contents and status, payment-related transaction information and administrative records. Third-party sellers receive data needed to fulfil orders, issue their invoices and arrange shipment. Legal bases: contract (Art. 6(1)(b)) and legal obligations where applicable (Art. 6(1)(c)). Sellers may act as independent controllers for their own sales, invoicing and shipping; their privacy notices may also apply.

Payments

Payments may be processed using Stripe or PayPal. MarketNail handles order and payment-status information; payment providers process the information needed to authorize transactions, detect fraud and meet applicable legal duties under their respective privacy roles and notices. The legal basis varies between contract, legal obligation and legitimate interests in security.

Support and service communications

We process contact details and messages to answer requests, handle complaints, send order information and maintain service continuity. Legal bases: contract or pre-contractual steps and, where appropriate, legitimate interests in responding to requests and documenting actions.

Newsletter and OneSignal

With a separate subscription, MarketNail sends promotional newsletters through OneSignal, using news@marketnail.com on mail.marketnail.com. Data may include email address, signup and consent records, preferences, delivery status, bounces and unsubscribe requests. OneSignal also provides measurements of email opens and link clicks; these interactions may be attributable to the recipient, while open statistics can be distorted by email privacy protections. Promotional messages rely on consent where required (Art. 6(1)(a) GDPR), subject to any applicable statutory exceptions. Individual-level open and click tracking requires a separate assessment of its legal basis and technologies: website cookie consent does not automatically authorize email tracking. Each promotional email includes an “Unsubscribe” link; you may also contact info@marketnail.com. OneSignal is not used for web push notifications.

Optional website analytics

With consent for statistics, we may use Google Analytics 4 (G-703RCBR1SQ) via Google Tag Manager (GTM-5NNSVTJ) to understand website usage. This may involve page events, technical device information and online identifiers. Legal basis: consent (GDPR Art. 6(1)(a)). GA4 must remain inactive until valid consent and may be disabled using cookie preferences.

Security and technical operations

We process IP addresses, technical logs, session identifiers and information needed to prevent fraud, protect accounts and provide secure payments and access. Legal bases: legitimate interests (Art. 6(1)(f)), contract and applicable legal obligations.

Recipients and providers

Authorized personnel and, as needed, providers may process information: OVHcloud (hosting), PrestaShop and Webkul components (platform and marketplace), Stripe and PayPal (payments), OneSignal (email), Google (analytics after consent), HubSpot solely for any remaining enabled synchronization, and technical advisers, support and logistics providers. Sellers receive order data necessary for fulfilment. Their roles as controllers or processors depend on the actual processing and contractual arrangements.

Transfers outside the EEA

Some providers may involve access to or processing of data outside the European Economic Area. Where a transfer falls under Chapter V of the GDPR, an appropriate legal mechanism must be used, such as an adequacy decision or standard contractual clauses, with supplementary safeguards where required. Information about applicable safeguards may be requested from the controller.

Retention

Personal data are retained for as long as needed for the described purposes and then to comply with legal obligations, protect legal claims or settle disputes. Account data are processed during the relationship and subsequently where necessary; accounting records subject to legal retention rules are held for the statutory period, which can be ten years for certain records; support requests and security logs are kept for periods proportionate to operational and security needs; newsletter data are used until unsubscribe or withdrawal, subject to retaining appropriate suppression records to prevent further mailings. Specific periods depend on the data category and systems concerned; applicable criteria may be requested from the controller.

Mandatory and optional information

Information marked mandatory is needed to create an account, manage orders or provide the requested service. Without it, some features will be unavailable. Newsletter subscriptions and analytics consent are optional and do not affect essential services.

Your rights

Subject to GDPR conditions, you may request access, correction, deletion, restriction and portability, and object to processing.
